Release and Waiver of Liability Agreement

Diamond Baseball Club (a.k.a. Diamond Dirtbags)

I, [athlete name] ("Participant"), acknowledge that I am voluntarily participating in the following activities with the Diamond Baseball Club (a.k.a. Diamond Dirtbags): Baseball Tryouts, Practices to include strength, agility and conditioning training, games and tournaments effective the date of this signed waiver and continuing in full effect until written notice is provided to the club.

I AM AWARE THAT THESE ACTIVITIES ARE HAZARDOUS ACTIVITIES AND THAT I COULD BE SERIOUSLY INJURED OR EVEN KILLED. I AM VOLUNTARILY PARTICIPATING IN THESE ACTIVITIES WITH KNOWLEDGE OF THE DANGER INVOLVED AND AGREE TO ASSUME ANY AND ALL RISKS OF BODILY INJURY, DEATH OR PROPERTY DAMAGE, WHETHER THOSE RISKS ARE KNOWN OR UNKNOWN.

As consideration for being permitted by the club to use fields and or premises to participate in these activities and use the premises and facilities for sports, I forever release the owners, agents or their assigned or any affiliated organization to include The Diamond Baseball Club, and their respective directors, officers, employees, volunteers, agents, contractors, and representatives (collectively "Releasees") from any and all actions, claims, or demands that I, my assignees, heirs, distributees, guardians, next of kin, spouse and legal representatives now have, or may have in the future, for injury, death, or property damage, related to (i) my participation in these activities, (ii) the negligence or other acts, whether directly connected to these activities or not, and however caused, by any Releasee, or (iii) the condition of the premises where these activities occur, whether or not I am then participating in the activities. I also agree that I, my assignees, heirs, distributees, guardians, next of kin, spouse and legal representatives will not make a claim against, sue, or attach the any property of any Releasee in connection with any of the matters covered by the foregoing release.

I HAVE CAREFULLY READ THIS AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT BETWEEN MYSELF AND DIAMOND BASEBALL CLUB, THEIR AGENT, COACHES, DIRECTORS, HEIRS, AND/OR ASSIGNEES, AND SIGN IT OF MY OWN FREE WILL.

Electronic Signature. By typing my full legal name below and submitting this form, I intend my typed name to be my electronic signature for this Release and Waiver of Liability Agreement. I agree that this electronic signature has the same legal effect, validity, and enforceability as a handwritten signature under the California Uniform Electronic Transactions Act (Cal. Civ. Code § 1633.1 et seq.) and the federal Electronic Signatures in Global and National Commerce Act (15 U.S.C. § 7001 et seq.). I consent to receive a copy of this signed agreement by email, and I understand that the Diamond Baseball Club will retain an electronic record of this signature — including timestamp, my initials, my IP address, and a cryptographic hash of the exact document I signed — as evidence of my agreement.

Diamond Dirtbags Player & Parent Code of Conduct

Welcome to Diamond Dirtbags Baseball. The following information, team standards, and player procedures serve as the contract between the player and the program — what it takes to be a member of the Dirtbags baseball program. Please read the following and ensure that both the player and the parent/guardian understand the general outline of our program. Two signatures are required for participation. A completed form is required before participation in any team event or practice.

General notes

It is your responsibility to be in constant communication with your head coach regarding attendance to organized team activities (in season, off-season team activities, and fundraisers). We promote participation in as many Dirtbags-sponsored activities as possible and will work with your schedule as much as possible.

Your commitment to the program begins upon acceptance of your roster spot and ends with each season. Roster spots are not guaranteed from season to season or team to team.

Communication between you and the coach is vital. As a player, you pledge to own the responsibility of communicating with your coach, and not rely on your parents.

Tryouts and active rosters

The Dirtbags baseball program and its coaching staff will select a team for its active roster at the start of each season. Participation in spring, summer, fall, or winter organized team activities and fundraisers does not guarantee you will be selected for the team.

During the tryout, each player will be evaluated based on character, effort, and current and projected abilities. Parent and player compatibility with the Dirtbags baseball team will be a top priority. Athletes participating in any other sport will be expected to participate in Dirtbags team activities including practices and games with the same level of commitment as all other players.

Following the evaluation, players will meet individually with their respective coaches to find out if they have made one of our teams. During this player/coach discussion, players offered a spot on the team will learn about the role their coach sees for them during the season, understanding that role may change. The goal of this process is to create complete transparency and ensure the athlete understands their role. This helps players decide if participating in Dirtbags Baseball is the best use of their time.

There are five role groupings assigned to each player:

Everyday Player — Initially viewed as a potential starter and everyday player.
Reserve — Likely not listed in the initial starting lineup, but has the potential to compete as an everyday player.
Developmental — Initially viewed as having very limited playing time in games. Players in this category must be motivated by being part of the team, contributing significantly during practices and team functions, and should take advantage of the opportunity to continue to develop their craft with the intention of earning playing time.
Not Selected — Players not selected for a team did not demonstrate the same level of character, effort, or current/projected abilities compared to their peers. Players not selected are encouraged to continue to work hard during the season and participate in our weekly clinic program.

The decision to move an athlete up or down a level of competition or to a different team within the Dirtbags organization will be made between the coaching staff and the player, with the intention of identifying the best situation for the player to gain an optimal experience.

Team standards and procedures — Player

As a player in the Dirtbags Baseball program, I agree to the following standards and principles:

I will accept and embrace my role in the program. I agree to fulfill my team responsibilities to the best of my ability every day. A player's role may change during the season; affected players will be informed.
If I have a problem understanding my role or a question regarding how to improve my position on the team, I will make an appointment to talk with the coach.
I agree to fulfill my responsibilities both on and off the field — including in the classroom — to the best of my ability, each and every day.
I will come prepared every day: mentally, physically, and properly equipped.
I will be a model of good citizenship on the field and off. Whether in a team meeting, gathering, or during practice, swearing is not allowed. Each occurrence, the team will run. Repeat offenders will be subject to disciplinary action including lost playing time, suspension, and/or removal from the team.
I will show good character in all areas of life — doing what's right when no one is watching, because it's the right thing to do.
I absolutely will not use or possess any illegal drugs (including performance-enhancing drugs) or alcohol. Participation in any such activity will be deemed a severe violation of team and organization policy and will be dealt with accordingly.
If I have a challenge with a teammate, I will try to resolve the issue with the player through conversation. If we are unable to solve the issue, I will involve a coach as a mediator.
I will communicate with my coaches.
We are as good as we think we are. Think positive, talk positive, and support our program, teammates, and coaches.
I will never talk about the program, a coach, or a teammate in a negative way, publicly. This includes any and all types of social media.
I will attend and be on time to all practices and workouts.
I understand that as a member of the Dirtbags baseball program, I will be held to a very high standard. I will conduct myself in a manner that brings a sense of pride to our program and team.

By initialing below, the player acknowledges they have read, understand, and agree to comply with this contract. Failure to follow this contract will result in disciplinary action, which could include suspension or removal from the team.

Team standards and procedures — Parent / Guardian

First and foremost, we as a baseball staff want to thank you for all that you have done and will do throughout the season. The time and effort you put forth to help our program and your athlete is greatly appreciated.

In an effort to improve communication and understanding, we require a parent contract for behavior and protocol.

Parents and guardians:

I will strive to be a positive spectator at all times. I will respect all players, coaches, officials, opponents, and other spectators.
I will not coach my player or any other player from the stands during practice or contests.
I have talked with my athlete about their role on the team and I understand and accept that their role, as deemed by staff, is "in the best interest of the team." A player/coach meeting will take place before each season.
I will make sure my athlete has communicated and shared with me the contents of the Player Contract. If at any time my athlete or I have difficulty understanding their assigned role on the team, I will encourage them to meet with the coach to discuss this issue first.
I understand that the only time a parent/coach meeting should take place is for the following reasons, and always after a 24-hour cooling-off period post-practice or post-game to allow emotions to be removed and to confirm if the issue even needs to be discussed: · After my athlete first spoke to the head coach regarding the issue or incident, a solution was not reached. The athlete is the first point of contact. · Concerns regarding the mental, emotional, academic, or physical well-being of the student-athlete. · Ways to help the athlete improve as a player and team member. · Family and/or school-related issues as they pertain to the athlete.
If I meet with the coach, I understand that playing time, comparisons to other players, and team strategies will not be discussed.
I understand that if I or my athlete violate the 24-hour cooling-off period, a penalty of reduced playing time will be imposed for 3 games. Repeat offenders are subject to removal from the team and organization.
